Reciprocal Tariff Exclusions – What You Need to Know

As part of current U.S. trade measures, certain products may be excluded from reciprocal tariffs. Below is a simplified list of qualified exclusions that importers should be aware of:

  • Canada (HTSUS 9903.01.26): Products from Canada, including those entered duty-free under USMCA, are excluded. If your goods are classified under 9903.01.10–9903.01.15, add 9903.01.26 as a secondary classification.
  • Mexico (HTSUS 9903.01.27): Products from Mexico, also under USMCA, qualify. If your goods fall under 9903.01.01–9903.01.05, include 9903.01.27 as a secondary classification.
  • Goods in Transit Before April 5, 2025 (HTSUS 9903.01.28): Goods must be loaded for shipment before April 5, 2025, and entered between April 5 and May 26, 2025, to qualify.
  • Column 2 Countries (HTSUS 9903.01.29): Goods from Belarus, Cuba, North Korea, and Russia are excluded from reciprocal tariffs.
  • Humanitarian Donations (HTSUS 9903.01.30): Food, clothing, and medicine donated by U.S. persons to relieve suffering are exempt.
  • Informational Materials (HTSUS 9903.01.31): Publications, films, CDs, posters, photographs, artworks, and news feeds are excluded.
  • Annex II Items (HTSUS 9903.01.32): Only items specifically listed in Annex II under the appropriate HTS subheadings qualify.
  • HTSUS 9903.01.33: Articles of iron or steel, derivative articles of iron or steel, articles of aluminum, derivative articles of aluminum, passenger vehicles (sedans, sport utility vehicles, crossover utility vehicles, minivans, and cargo vans) and light trucks and parts of passenger vehicles (sedans, sport utility vehicles, crossover utility vehicles, minivans, and cargo vans) and light trucks, of any country, subject to Section 232. actions.
  • Chapter 98 Entries: Most Chapter 98 entries are exempt, except for 9802.00.40, .50, .60, and .80 — which are subject to tariffs on repair or foreign assembly value.
  • Foreign Trade Zone Admissions: Goods admitted to FTZs on or after April 9, 2025, must be under “Privileged Foreign Status” to apply the proper duty at the time of FTZ admission.
  • U.S. Content (HTSUS 9903.01.34): If at least 20% of the product’s value is U.S.-origin, only the non-U.S. portion will be subject to the tariff.
  • New Product Exclusions (Effective April 5, 2025)
  • Importers must properly classify products under one of the HTSUS headings or subheadings below and report the secondary classification under 9903.01.32 to claim the exemption from reciprocal tariffs:
  • 8471 – Automatic data processing machines and units thereof
  • 8473.30 – Parts and accessories for machines of 8471
  • 8486 – Machines and apparatus for manufacturing semiconductor devices
  • 8517.13.00 – Smartphones
  • 8517.62.00 – Machines for the reception, conversion and transmission or regeneration of voice, images or other data, including switching and routing apparatus
  • 8523.51.00 – Solid-state non-volatile storage devices
  • 8524 – Flat panel display modules, whether or not incorporating touch-sensitive screens:
  • 8528.52.00 – Capable of directly connecting to and designed for use with an automatic data processing machine of heading 8471
  • 8541.10.00 – Diodes, other than photosensitive or light-emitting diodes (LED)
